The tenancy is terminated effective March 31, 2021. The Tenant must pay the Landlord $19,035.88, which includes rent arrears up to the termination date and the cost of filing the application, less the rent deposit and interest on the deposit. The Tenant must also pay $59.18 per day for compensation for use of the unit starting March 11, 2021 until the Tenant moves out. If the Tenant pays the Landlord $22,608.15 on or before March 31, 2021, the eviction order will be void and the tenancy will continue.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Landlord's Agent testified that the Landlord has been reaching out to the Tenant since the arrears of rent started accumulating in February 2020 and the Tenant never responded until January 15, 2021. Landlord's Agent testified that the arrears of rent are significant and that any delay in eviction would prejudice the Landlord as the arrears of rent would continue to accumulate.
Tenant would like the opportunity to preserve the tenancy in hopes that he will be able to pay the arrears of rent in full to the Landlord.
Tenant testified that he lost his job and had to rely on Employment Insurance, which was inadequate to pay all of his bills and the rent.
