The Board denied the Interested Party's request to review the Board-initiated review order, finding no serious error in the order. The Board determined the Interested Party abused the LTB's process by improperly obtaining the trust funds paid by the Tenant, and ordered the Interested Party to repay the funds.
The Interested Party (former landlord) applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The application was initially granted, but the Tenant filed a motion to void the order after paying the arrears. The Board-initiated a review to determine if the Interested Party improperly received the trust funds paid by the Tenant.
