The Landlord's application to terminate the tenancy and evict the Tenant is granted. The tenancy is terminated effective March 31, 2025 to allow the Tenant, who has a son with a disability, time to make alternative arrangements. The Tenant is ordered to pay the Landlord $4,198.32 in compensation for use of the unit from December 13, 2023 to May 28, 2024, minus any amounts already paid, and an additional $24.99 per day from May 29, 2024 until the Tenant vacates the unit. The Landlord is also entitled to $186 for the application filing fee.
The Tenant has a son with a disability who would benefit from a postponed eviction date. The postponed eviction date will allow the Tenant time to contact support organizations and make arrangements.
Landlord applied to terminate the tenancy and evict the Tenant due to the Tenant's aggressive behavior towards the Landlord's agents and employees, the Tenant's refusal to allow access for pest control and other valid reasons, and the Tenant's installation of supplemental locks that prevented the Landlord from entering the unit. The Landlord also claimed compensation for the Tenant's continued occupancy of the unit after the termination date.
The Landlord's property manager testified to incidents where the Tenant approached her at her car and screamed at her, and another incident where the Tenant yelled at the Landlord and fire department when they attempted to enter the rental unit after giving proper notice.
The Tenant alleges that the Landlord wants to evict her because of her son who has a disability, and that she only denied the Landlord entry one time when they were trying to interfere and were not entitled to enter the unit to check for compliance with the fire department order.
The Tenant stood in front of the Landlord's office saying 'Medallion (the property management company) can go fuck right off'. The Tenant yelled at the Landlord's agents and employees on multiple occasions, and refused access for pest control and other valid reasons despite receiving valid notices of entry from the Landlord.
The Tenant has not taken responsibility for her misconduct and continues to misapprehend or dispute the Landlord's right to inspect the unit with proper notice.
