The Tenant's motion to set aside the previous order is denied. The stay on the original order is lifted immediately. The Tenant failed to meet the conditions of the previous order and did not provide sufficient justification for non-compliance. The Tenant has the financial means to make the required payments but has not presented a reasonable repayment plan.
Landlord applied for an order to terminate the tenancy and evict the Tenants due to their failure to meet a condition specified in a previous LTB order. The Tenants filed a motion to set aside the order.
Tenant requested the order be replaced with a voidable order giving the Tenant a chance to pay the arrears by a certain date, and suggested the Tenant may be eligible for municipal housing assistance.
Tenant was in a serious work accident and was unable to comply with the payment plan. Tenant claimed she had chest pains but did not provide a specific diagnosis or details on why she was unable to work.
