The Landlords' application is dismissed. The Landlords did not obtain all necessary permits for the planned renovations, and did not show that vacant possession is required. The Tenant must pay back the 3 months' rent compensation to the Landlords.
Landlords did not meet requirements under s. 73 of the Act
Landlords applied to terminate the tenancy and evict the Tenant in order to complete extensive renovations to the rental unit, including removing and replacing drywall, electrical wiring, plumbing, and other major work. The Landlords served the Tenant an N13 Notice of Termination, and the Tenant attended the hearing and received Tenant Duty Counsel services.
Landlords' application is not made in good faith, as they have not obtained all necessary permits and the renovations do not require the Tenant's eviction.
