The tenancy is terminated effective August 6, 2021. The Tenant must pay the Landlord $19,238.54, which includes rent arrears up to July 26, 2021 and the cost of filing the application, less the rent deposit and interest owed on the deposit. The Tenant must also pay $47.97 per day for compensation for use of the unit starting July 27, 2021 until the Tenant moves out. If the Tenant does not pay the full amount by August 6, 2021, the Landlord may file the order with the Sheriff to enforce the eviction.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
Landlord opposed the Tenant's proposed payment plan, arguing the length of time to repay the arrears is unreasonable and the plan does not account for all arrears owing or future rent payments.
Tenant proposed a payment plan to pay $5,500 on October 30, 2020 and $25 per month starting November 1, 2020 until October 1, 2021, with $500 payments on October 1 and November 1, 2021.
Tenant's employment was affected by COVID-19 and she is currently receiving Unemployment Insurance.
