If the Tenant does not void the order, they must pay the Landlord $19,936.02, which includes rent arrears and the application filing fee, minus the rent deposit and interest. The Tenant will also owe daily compensation of $57.53 for each day of occupation starting December 21, 2023 until they move out.

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
Tenant testified that she has not paid rent since February 2023, tried to raise a maintenance issue, had an emergency surgery in October 2023 which caused her to lose her job in December 2023, and prioritized other bills over rent payments.
