The Landlord proved the grounds for termination, but the Tenant was granted conditional relief from eviction. The Tenant must pay rent on time for 1 year, otherwise the Landlord can apply to terminate the tenancy. The Tenant must pay the Landlord's application fee.
Tenant recently aged out of foster care, had financial difficulties, and now has a job to pay rent on time
Landlord applied for an order to terminate the tenancy and evict Tenant due to substantial interference with the Landlord's rights, damage to the rental unit, and persistent late payment of rent. The Landlord alleged the Tenant left belongings on the fire escape, obstructed access to the main entrance, littered in the hallway, caused water damage from leaking fish tanks, and was persistently late in paying rent.
Landlord argued he needs rent paid on time to pay his own bills and mortgage.
Landlord alleged Tenant's fish tanks were leaking and causing damage to commercial unit below, but did not provide evidence to support this claim.
Tenant presented evidence that her fish tanks were not leaking and causing damage to the commercial unit below.
Tenant refused entry to Landlord's agent to inspect rental unit due to not knowing who the agent was. Tenant yelled at tenant in unit above due to their car alarm going off at 3am.
